The whole point of the NICA program is that if the obstetrician was a member of NICA and the baby's injuries fit the narrow definitions and fall under the NICA plan, then the hospital and every doctor, nurse, and other healthcare provider attending the delivery are immune from liability and may not be sued for damages. It does not matter if the person who actually committed the malpractice is not a member of NICA. If an obstetrician in attendance was a member, all the healthcare providers are granted immunity from suit and the only recourse is to seek the benefits available under NICA, unless you fit an exception which might allow you to avoid NICA.
